SECTIONAL EDGE — TERMS OF SERVICE

Effective date: 5 September 2026

These Terms of Service (“Terms”) govern your access to and use of the Sectional Edge website, subscriptions, memberships, racing analysis, rated markets, selections, articles, newsletters and related content.

The Sectional Edge website and services are operated by Heath Pope, a sole trader trading as Sectional Edge (ABN 81 961 308 600) (“Sectional Edge”, “we”, “us” or “our”).

By creating an account, purchasing a subscription, accessing subscriber content or otherwise using our services, you agree to these Terms and our Privacy Policy. If you do not agree, you must not purchase or use the services.

1. Eligibility and age restriction

Sectional Edge is intended exclusively for people aged 18 years or older.

By creating an account or purchasing a subscription, you confirm that:

  • you are at least 18 years old;

  • you have the legal capacity to enter into these Terms;

  • the information you provide is accurate and complete; and

  • your use of the services is lawful in the jurisdiction from which you access them.

We may request reasonable evidence of age or identity. We may suspend or terminate access where we reasonably believe a person is under 18 or has provided false information.

2. Nature of the service

Sectional Edge provides horse-racing information, form analysis, sectional analysis, ratings, rated prices, selections, opinions and related editorial content.

Sectional Edge is not a bookmaker, wagering operator, financial adviser or financial product provider. We do not accept or place bets on behalf of subscribers and do not control the markets, prices or services offered by wagering providers.

Our content is supplied for informational and entertainment purposes. It represents opinion and analysis based on information reasonably available at the time of publication.

Nothing published by Sectional Edge constitutes:

  • a guarantee of a particular racing or wagering outcome;

  • personal financial advice;

  • a recommendation tailored to your financial circumstances;

  • a representation that a runner will win or place;

  • a guarantee that an advertised market price will remain available; or

  • an assurance that a subscriber will make a profit.

3. Racing and wagering risk

Horse racing and wagering involve uncertainty and financial risk. Outcomes may be affected by factors including track conditions, weather, barriers, tactics, interference, scratchings, jockey decisions, race tempo, inaccurate source data and unforeseen events.

Rated prices represent Sectional Edge’s assessment of probability and value. They are not predictions of certainty and are not bookmaker prices.

Past performance, strike rates and previous results do not guarantee future performance.

You remain entirely responsible for:

  • deciding whether to place a wager;

  • selecting a wagering provider;

  • determining the amount, if any, that you wager;

  • checking current odds, deductions and wagering conditions; and

  • ensuring that your wagering is lawful and affordable.

Never wager more than you can afford to lose. Do not chase losses, borrow money to wager or treat wagering as a dependable source of income.

If gambling is causing concern, contact the National Gambling Helpline on 1800 858 858, visit gamblinghelponline.org.au, or visit betstop.gov.au to learn about national self-exclusion.

4. Accounts

You may need to create an account to access paid content.

You agree to:

  • provide accurate and current account information;

  • keep your login details confidential;

  • use a secure password;

  • promptly update information that changes;

  • notify us if you suspect unauthorised access; and

  • accept responsibility for activity occurring through your account, except to the extent caused by our failure to take reasonable care.

Each subscription is for one individual subscriber only. You must not allow another person to use your account or login details.

We may require a password reset or temporarily restrict access where reasonably necessary to protect an account, our website or other subscribers.

5. Subscriptions and automatic renewal

The subscription period, price, billing frequency and included services will be displayed before purchase.

Unless expressly identified as a non-renewing purchase, subscriptions renew automatically at the end of each billing period using the payment method associated with your account.

By purchasing an automatically renewing subscription, you authorise us and our payment provider to charge the applicable subscription fee at the beginning of each renewal period until you cancel.

You are responsible for reviewing the subscription price, billing frequency and renewal terms before completing your purchase.

6. Prices and payments

All prices are displayed in Australian dollars unless stated otherwise.

Prices will indicate whether GST is included, where applicable.

Payments are processed through third-party payment providers. Sectional Edge does not ordinarily receive or store your complete payment-card details.

You must provide valid payment information and ensure sufficient funds are available when payment is due.

If a payment is declined, reversed or remains unpaid, we may:

  • retry the payment;

  • temporarily suspend access;

  • request an alternative payment method; or

  • cancel the subscription after providing reasonable notice.

We may change subscription prices from time to time. A price change will not retrospectively alter a period already paid for. We will provide reasonable notice before applying an increased price to a future renewal, and you may cancel before that renewal.

7. Cancelling a subscription

You may cancel an automatically renewing subscription through your online customer account before the next renewal date.

Cancellation prevents future renewals. Unless otherwise stated or required by law:

  • cancellation takes effect at the end of the current paid billing period;

  • you will retain access until that period ends;

  • no further subscription payment will be charged after the effective cancellation date; and

  • deleting an account, unsubscribing from marketing emails or failing to use the service does not by itself cancel a paid subscription.

You are responsible for completing cancellation before the renewal payment is processed.

If you experience a genuine technical problem preventing online cancellation, contact us promptly at [CONTACT EMAIL].

8. Refunds and Australian Consumer Law

Because subscription content is digital and may become available immediately after purchase, we do not ordinarily provide refunds for:

  • change of mind;

  • failure to use or read the content;

  • dissatisfaction with a racing result;

  • losing wagers;

  • disagreement with an opinion, rating or selection;

  • failing to cancel before a renewal;

  • changes in bookmaker prices; or

  • a selection being unsuccessful.

We also do not ordinarily provide partial refunds for the unused remainder of a billing period following a voluntary cancellation.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law.

Where a service fails to comply with a consumer guarantee, you may be entitled to a remedy required by law. The appropriate remedy will depend on the nature and seriousness of the failure.

Refund requests can be submitted to [CONTACT EMAIL] with the subscriber’s name, account email, payment date and reason for the request.

9. Publishing schedule and content availability

Sectional Edge aims to publish content according to the schedule or description displayed on the website. Racing content is time-sensitive, and publication times may vary.

We may change, delay, update, correct or withdraw content where reasonably necessary because of:

  • scratchings or field changes;

  • altered race times or meeting schedules;

  • track or weather changes;

  • abandoned, transferred or postponed meetings;

  • unavailable, incomplete or incorrect source data;

  • technology or supplier interruptions;

  • illness, emergency or circumstances outside our reasonable control; or

  • an error requiring correction.

A change affecting an individual race, runner, selection or meeting does not automatically entitle a subscriber to a refund.

However, if paid services are not supplied as described or cannot be accessed for a substantial period, we will provide any remedy required by Australian Consumer Law.

10. Corrections and updates

We take reasonable care in preparing our content, but racing information can change rapidly and may originate from third-party sources.

Subscribers should independently confirm current information before wagering, including:

  • final fields and scratchings;

  • barriers and rider changes;

  • race times;

  • track conditions;

  • deductions;

  • bookmaker prices; and

  • official race-day announcements.

We may correct or update content without notice when errors, omissions or changed circumstances are identified.

11. Intellectual property

Unless otherwise stated, all original Sectional Edge content is owned by or licensed to Heath Pope trading as Sectional Edge.

This includes, without limitation:

  • written analysis;

  • ratings and assessed prices;

  • race previews and reviews;

  • newsletters;

  • tables and graphics;

  • presentation slides;

  • page layouts;

  • branding and logos;

  • analytical frameworks;

  • selection summaries; and

  • compilations and presentation of information.

A paid subscription grants you a limited, personal, non-exclusive, non-transferable and revocable right to access the content for your own private use during an active subscription.

Purchasing access does not transfer ownership of the content or grant commercial publication rights.

12. Prohibited use and content sharing

Without our prior written permission, you must not:

  • share your account or login details;

  • forward subscriber emails or newsletters;

  • copy, reproduce or republish paid content;

  • upload paid content to social media, forums, messaging groups or other websites;

  • distribute screenshots, images, PDFs or presentation slides;

  • sell, sublicense or commercially exploit our content;

  • make paid content available to another person;

  • systematically download or archive content;

  • scrape, extract or harvest website data;

  • use automated tools to access or reproduce the service;

  • remove copyright, branding or attribution notices;

  • represent Sectional Edge content as your own; or

  • use our material to operate or support a competing paid tipping or racing-analysis service.

Brief personal notes made solely for your own use are permitted.

13. Suspension and termination

We may suspend or terminate an account where we reasonably believe that:

  • subscription fees remain unpaid;

  • login details have been shared;

  • content has been copied, distributed or resold;

  • the website is being accessed through automated or abusive methods;

  • fraudulent or unlawful conduct has occurred;

  • another person’s rights have been infringed;

  • these Terms have been seriously or repeatedly breached; or

  • suspension is reasonably necessary to protect the service or its users.

Where appropriate, we will provide notice and a reasonable opportunity to address the issue. Immediate suspension may occur where urgent action is reasonably necessary to prevent fraud, security risks, unlawful conduct or unauthorised distribution.

Any refund following termination will be determined according to the circumstances and applicable law.

Clauses concerning intellectual property, prohibited use, liability, disputes and other provisions intended to continue will survive termination.

14. Third-party services and links

The website may contain links to bookmakers, racing organisations, data providers, payment providers, social-media platforms and other third parties.

Third-party services are operated independently and may have their own terms, privacy policies, eligibility requirements and wagering rules.

Unless expressly stated, a link or reference does not mean that Sectional Edge controls, guarantees or endorses the third party or its products.

We are not responsible for:

  • the continued availability of third-party websites;

  • bookmaker prices or deductions;

  • the acceptance, settlement or refusal of wagers;

  • account restrictions imposed by wagering providers;

  • third-party outages or errors; or

  • losses caused by a subscriber’s dealings with a third party,

except to the extent responsibility cannot lawfully be excluded.

Subscribers should use only wagering services legally available in their jurisdiction.

15. Service availability and website security

We aim to keep the website and subscriber services reasonably available. Continuous, uninterrupted or error-free access cannot be guaranteed.

Access may be interrupted for maintenance, updates, security work, internet failures, hosting outages or circumstances outside our reasonable control.

You must not:

  • attempt to bypass website security;

  • interfere with the operation of the service;

  • introduce malicious code;

  • probe for vulnerabilities;

  • access another subscriber’s account; or

  • use the service in a way that imposes an unreasonable burden on our systems.

16. Disclaimer of guarantees

To the maximum extent permitted by law, we do not guarantee:

  • the accuracy or completeness of every item of racing data;

  • that any selection will win or place;

  • that rated prices will correspond with bookmaker markets;

  • that a subscriber will make a profit;

  • that content will always be published at a particular time;

  • that every scheduled race or meeting will be covered; or

  • uninterrupted availability of the website.

This clause does not exclude guarantees or obligations that cannot legally be excluded.

17. Limitation of liability

Nothing in these Terms excludes, restricts or modifies liability where doing so would be unlawful, including liability arising under Australian Consumer Law.

Subject to those non-excludable rights, Sectional Edge is not responsible for wagering losses or decisions made by a subscriber in reliance on racing opinions, ratings, selections or assessed prices.

Where the law permits liability to be limited, our liability will be limited to an appropriate remedy permitted by law, which may include supplying the affected service again or paying the reasonable cost of having it supplied again.

This clause must be read subject to all rights and remedies available under applicable law.

18. Privacy

Our collection, use, storage and disclosure of personal information are governed by our Privacy Policy.

By using the website, you acknowledge that Squarespace, payment providers, email providers and other service suppliers may process information as reasonably necessary to operate the service, subject to their applicable privacy obligations.

Marketing communications can be unsubscribed from using the link included in the message. Service-related communications concerning payments, account security, subscriptions or important operational matters may still be sent while you hold an account.

19. Changes to the service

We may reasonably change or improve the website, content format, publishing process and subscription features.

If a change materially reduces the core benefit of a prepaid service, we will provide reasonable notice where practicable and any remedy required by law.

20. Changes to these Terms

We may update these Terms to reflect changes to the service, technology, suppliers, pricing arrangements or applicable law.

The current version will be published on the website with an updated effective date.

Where a change materially affects an active paid subscription, we will provide reasonable advance notice where practicable. Continuing to use the service after the change takes effect constitutes acceptance of the updated Terms, except where additional consent is required by law.

21. Complaints and disputes

If you have a concern about the service, contact us first so we can attempt to resolve it.

Please email [CONTACT EMAIL] and include:

  • your name;

  • your account email;

  • a description of the issue;

  • the outcome you are seeking; and

  • any relevant payment or subscription details.

We will consider the complaint in good faith and aim to respond within a reasonable period.

These Terms do not prevent you from exercising any right to contact a consumer-protection agency or pursue a remedy available under law.

22. Governing law

These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws.

You and Sectional Edge submit to the courts and tribunals having jurisdiction in New South Wales, subject to any consumer right to bring a claim in another jurisdiction.

23. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down to the extent necessary or severed. The remaining provisions will continue to operate.

24. No waiver

A failure or delay in exercising a right under these Terms does not waive that right.
